1 Overview
These Terms govern your access to and use of the website and any purchases you make from LOTUS GEMS & JEWELLERY PTY LTD. By using the website or placing an order you agree to be bound by these Terms together with our Returns and Refund Policy and our Privacy and Cookies Policy.

We us our means LOTUS GEMS & JEWELLERY PTY LTD. You your means the person or entity accessing the website or purchasing goods. Product means any gemstone jewellery or related goods sold by us.
3 Eligibility and account information
You must be at least 18 years old to purchase from our website. By placing an order you confirm you are legally capable of entering into a binding contract and that all information you provide is accurate and complete. Keep billing and shipping details up to date.
4 Orders acceptance and cancellations
An order is accepted when we send an order confirmation email. We may refuse or cancel any order at our discretion including orders suspected of fraud. If we cancel after payment we will issue a full refund.
5 Pricing payment and refunds
All prices are in Australian dollars unless otherwise stated. We reserve the right to correct pricing errors. Payment must be authorised and cleared before dispatch. For high value orders we may require identity verification and may delay shipment until verification is complete. Refunds will be issued to the original payment method in accordance with our Returns and Refund Policy.
6 Shipping delivery and international trade
We ship internationally using insured and trackable carriers. Delivery times are estimates only. Risk of loss transfers to you on confirmed delivery. You are responsible for providing a correct shipping address and for any import duties taxes or customs charges. International customers must ensure gemstones are legally importable into their country.
7 Product descriptions authenticity and gemstone characteristics
We sell natural gemstones and fine jewellery. Natural gemstones may show variations in colour clarity inclusions and other internal characteristics. Measurements and weights are approximate. Any gemstone treatments will be disclosed where applicable. Microscopic inclusions natural colour zoning and other natural features are not defects. Differences of opinion between recognised laboratories do not by themselves constitute misrepresentation.
8 Custom orders and deposits
Custom sourced gemstones and bespoke jewellery are final sale and cannot be cancelled once sourcing or production has commenced except where required by law. Deposits for custom work are non refundable except where required by law. Specification changes must be agreed in writing before production begins.
9 Discounts promotions and giveaways
- Promotions are valid only for the dates and terms specified.
- Discount codes cannot be combined with other discounts offers or promotions unless expressly stated.
- From time to time we may run free gemstone giveaways up to twice per calendar year. Giveaway terms will set entry requirements and data use. By entering you consent to our use of your personal information in accordance with our Privacy and Cookies Policy.
10 Consumer guarantees and remedies
Nothing in these Terms limits your rights under the Australian Consumer Law. If a product is not of acceptable quality is significantly different from its description or is not authentic you are entitled to remedies including repair replacement or refund.
11 Fraud prevention anti money laundering and identity verification
We may refuse transactions involving sanctioned individuals or countries and report suspicious transactions to relevant authorities. We may require identity verification and additional documentation for high value purchases.
12 Intellectual property and permitted use
All website content including images product descriptions logos and branding is our property. You may not copy reproduce or use our content without prior written permission. Automated scraping or data extraction is prohibited.

We make every effort to ensure accuracy; however, minor typographical errors, measurement variances, or descriptive inaccuracies that do not materially affect the product do not constitute grounds for cancellation or refund. We reserve the right to correct errors without notice.

Gemstone grading involves subjective professional opinions. Differences between recognised laboratories regarding colour, clarity, origin, or treatment do not constitute misrepresentation or grounds for refund.
19. Delivery Confirmation and Risk Transfer
Delivery is deemed complete when the carrier confirms delivery to the address provided, regardless of signature or collection by another person. Risk transfers to you upon carrier confirmed delivery.
20. Incorrect Shipping Addresses
You are responsible for providing an accurate shipping address. We are not liable for delays, loss, or non delivery resulting from incorrect or incomplete addresses. Re delivery or replacement costs are your responsibility.
21. Currency Conversion and International Refunds
All transactions and refunds are processed in AUD. We are not responsible for exchange rate differences, currency fluctuations, or bank fees.
22. Delivery Delays and External Disruptions
